This Privacy Statement describes how Smartdc B.V. user Personal Data of (prospective) clients, suppliers and (website) visitors. In this statement we describe how we collect, store, secure and use your Personal Data when you purchase our services, supply products or services to us, visit our premises or access our website (https://www.smartdc.net) and that of any affiliate companies.

When we refer to “Smartdc”, “we”, “us” in this Privacy Statement, we refer to the Smartdc B.V. as the entity, which is responsible for your Personal Data and acts as “Data Controller”. Smartdc B.V. is the entity with whom you intend to agree – or have agreed – a contract, whose premises you have visited, whose website you have accessed or with whom you interact. Smartdc B.V., is located at Van Nelleweg 1, 3044 BC, Rotterdam, The Netherlands and is the data controller for the data processing.

When we refer to Personal Data in this Privacy Statement, we mean any information through which we can identify you as an individual. Below you can read what Personal Data we collect and may process.

Complying with GDPR

When processing data, we comply with the requirements laid down in the General Data Protection Regulation (GDPR). That means, among other things, that we:

  • Clearly state the purposes for which we process personal data. We do this in line with this Privacy Statement and a separate Cookie Statement.
  • Limit our collection of personal data to only personal data that is necessary for legitimate purposes.
  • We will first ask for your explicit consent to process your personal data, where your consent is required.
  • Take appropriate measures to protect your personal data, including the requirements of parties who process personal data on our behalf.
  • Respect your right to access, correct, supplement, modify, block, delete or transfer your personal data upon your request.

When does Smartdc collect personal data?

Smartdc collects your personal data when:

  1. You create a Smartdc-account
  2. You use a Smartdc-service
  3. You subscribe to the Smartdc’s newsletter
  4. You consult Smartdc (direct or via our online contact form), with a request, question, comment, or complaint
  5. You report abuse to Smartdc

When required Smartdc may also request information from Fraud Prevention Agencies (FPAs), Credit Reference Agencies (CRAs) and Blocklists.

What type of personal data is collected by Smartdc?

The following of your data will be collected by Smartdc:

  1. Your full name
  2. Your date of birth
  3. Your gender
  4. Your address details
  5. Your e-mail address
  6. Your phone number
  7. Your IP-address
  8. The number of your identity document and its expiry date
  9. Your fingerprint (Only, required when you wish to visit the data center in person)
  10. A unique administrative number that does not contain any information other than that referred to in 1 to 9

In this privacy and cookie declaration, we explain which personal data we collect, use and for what purpose. We recommend that you read them carefully. How Smartdc collects personal data?

Your personal data will be collected by Smartdc when:

  1. An account is created at Smartdc;
  2. Services are used from Smartdc;
  3. Subscribing to the newsletter of Smartdc;
  4. Smartdc is consulted (via the contact form) with a request, question, comment or complaint;
  5. Abuse is reported at Smartdc.

What type of personal data is collected by Smartdc?

The following of your data will be collected by Smartdc:

  9. Your fingerprint (when registering at the data center);
  10. An administration number that does not contain any information other than that referred to in 1 to 9.

Why Smartdc processes your personal data?

Smartdc collects and processes your data for the following purposes:

  1. To offer, manage, and carry out Smartdc services.
  2. Write and send invoices on behalf of Smartdc.
  3. Send emails, displaying on the website, sending by post, and notifying by phone of a newsletter, user information, service message or other electronic message.
  4. To inform you about new Smartdc products and/or services.
  5. To analyze your interaction with the Smartdc website, to better suite it to your preferences, offer you better products and services and to improve the navigation and content of the Smartdc website in general.
  6. To investigate possible violations of the Smartdc Acceptable Use Policy (AUP).
  7. To determine your identity if you wish to access a Smartdc data center and/or office.
  8. To comply with the applicable laws and regulations.

How Smartdc discloses personal data?

Smartdc may share your data with the following third parties:

  1. Law enforcement agencies, courts, or governing bodies when Smartdc is required (and permitted) to do so by law. The types of responses include, but are not limited to subpoenas, search warrants, law enforcement requirements, protection of our company and national security.
  2. Debt collection agencies or debt recovery organizations.
  3. Our affiliate company, i3D.net, to provide support services.

Manage your data

You can access your Smartdc account via the portal. There you access the control environment to setup, specify, or change your preferences and personal data. Smartdc respects your right to access and correct your personal data. If you require any assistance to amend or change your personal data, please contact us.

Data Retention

Smartdc retains your personal data only, if necessary, for the fulfillment of the purpose(s) for which it was collected and for which consent was received, unless otherwise required by law. Personal data that is no longer required to fulfill the identified purpose is deleted or made anonymous.

Regarding the newsletter, we store your e-mail address to send you our Smartdc-newsletter until you deregister yourself.

In the case of a Smartdc application, we will keep this information for a maximum of four weeks. If we wish to retain the data for a longer period, we will do, after we receive your permission, for a maximum of one year.

Protection

Smartdc takes technical and organizational security measures to prevent loss, misuse, and/or unauthorized access to any personal data. In doing so, we ensure that these measures are designated as an appropriate level of security within the meaning of the GDPR. We are obliged to test these security measures at planned intervals for ISO 27001 and NEN 7510, which is subject to annual and independent external audits.

Third party websites

This privacy statement does not apply to websites of third parties that are linked to this website. We cannot guarantee that these third parties will handle your personal data in a reliable or secure manner. We recommend that you read the Privacy (and their cookie statement) statement of each respective website before using them.

Newsletter

We send an electronic newsletter once every quarter. This newsletter is only sent with the consent of the data subject concerned and contains news and advertising. You will find an unsubscribe link in every edition.

Objection to direct marketing

You have the right to object to direct marketing. Each newsletter contains a link that allows you to unsubscribe from the newsletter distribution list. If you wish to file a complaint against direct marketing, you can create a ticket in your portal or send an e-mail to marketing@smartdc.net. In this message you must state to whom this request relates.

Dutch Data Protection Authority

Smartdc always attends to any question or complaint you have about its processing of your personal data. You can reach us via the contact details below, or through our online contact form. If you are dissatisfied with the way in which we deal with your complaint, you have the right to submit a complaint to the Dutch Data Protection Authority. You can contact the Dutch Data Protection Authority for this purpose.

What are your rights?

You have the following rights:

  • Receive an explanation, what personal data we have from you and what we do with it.
  • Access your personal data we have from you.
  • Correct any inaccuracies in your personal data.
  • Removal of (outdated) personal data.
  • Withdraw your consent to our cookies.
  • Object to a certain use of your personal data.
